The OJEU Notice
Contracting authorities should state that they are seeking sustainability requirements in their OJEU notice. If these are a core requirement, they could be built into the award criteria and weighted in the assessment for value for money. If these requirements are secondary or additional they shouldn’t be a consideration in the award process.
If you are planning to have a workshop or a supplier event then think about publishing a Prior Information Notice (PIN) in the OJEU giving the details of the day and inviting attendance.
The Legal Shelf offers the following model wording
“Under this [procurement / project] the [contractor / developer] is required to
participate actively in the economic and social regeneration of the locality of and
surrounding the place of delivery for the [procurement / project]. Accordingly
contract performance conditions may relate in particular to social and
environmental considerations.”
