Is Local Legal?

ArchitectureTo exclude any business, social enterprise or third sector organisation across the European Union from a procurement exercise in South East Northumberland is clearly illegal. Best practice would indicate that competition for opportunities below these levels should be encouraged. We want to strengthen our local economy and make our businesses competitive and sustainable in the long term.

We can do this in a number of ways:

As procurers, thinking about what we want to buy and how we want to buy it and using a whole life costing approach. If we think carefully about how we package tenders together and how our tenders are worded we can ensure that no business is excluded from the exercise.

As procurers, we can identify quotation opportunities and ensure that they reach local suppliers and that the market is opened up to competition. Rotating the requests ensures that more local businesses get a chance to quote.

This guidance does not remove the need to seek appropriate legal advice in respect of the application of the EU rules to a particular procurement, nor to seek other professional advice where appropriate.
